TERMS AND CONDITIONS OF SALE
The Hot Tub Supercentre is a trading name of American Hot Tubs Ltd, Reg SC521235 with registered address 1 Gateway Business Park Grangemouth, Scotland. FK3 8WX.
These terms of sale apply to your installation and by placing an order, you agree to the terms and conditions set out below; The placing of an order commences when an optional deposit has been paid in full or when your finance agreement has been signed.
These Terms and Conditions override any terms or conditions proposed by the buyer unless specifically agreed in writing by American Hot Tubs and, together with the agreed price for the goods, constitute the entire agreement for the sale. For the purposes of these terms and conditions, spa describes both portable spas and hot tubs.
Each quotation or proforma invoice will show the agreed price for the goods and any extras plus any delivery or set up charges and VAT, this will only remain valid for 7 days from the date of issue, unless otherwise stated
All orders require a deposit of £0. Any deposits placed however will be noted. Should any order and/or deposit be paid upfront and then cancelled within 30 days for any reason then 90% of this will be refunded with the remaining 10% being retained by American Hot Tubs to cover administration and consultancy work already carried out. If an order is cancelled outwith 30 days, American Hot Tubs will retain the full deposit paid. If your order is being paid for in connection with a finance agreement then your finance agreement is confirmation of your order/goods.
American Hot Tubs will ensure that a full detailed description is given to you in regards the access requirements needed for getting your hot tub into the garden, this will include a document that will be sent out as via email either as an attachment or a website link. American Hot Tubs will request photographs in order to establish suitable access points and suitability for access of the tub to your garden and will liase with you in regards the measurements required for safe and required space. Should access photos not be sent it will be the responsibility of the customer to and all liability of not being able to install the tub on that day lies with the customer. In the case of a hi-ab or crane being used to position the tub by a third party, even if arranged by American Hot Tubs, the sole responsibility of the tub during this movement of the tub will be between you as the customer and the 3rd party hi-ab or crane company and we will take no responsibility for any loss or damage occurred during that time to hot tub and any property. The payment of such machinery is the full responsibility of the customer.
Delivery and set up is included in the price of the goods unless clearly stated. Islands will be subject to a delivery charge, please call for a quotation. Any time or date for delivery given is an estimate only and it is not the essence of contract and if the delivery is delayed, under no circumstances can compensation be considered or paid. This includes circumstances where you have been given and install date but this is then cancelled and has to be re arranged due to your tub not arriving from our suppliers. American Hot Tubs will not be liable for any costs or loss of income or time that you may occur as a result of date changes of your delivery or installation. If American Hot Tubs agree to delivery and on attending the site on the confirmed day, are unable to affect delivery due to a buyer being unprepared, a return visit to deliver the spa will incur a minimum cost of £250.00. This includes but is not limited to no or incorrect electrical set up in place, access issues that have not been flagged up to American Hot Tubs prior to install day or unsuitable base for tub siting. If any cause outside of the control of American Hot Tubs makes it impractical for American Hot Tubs to complete the order and supply the hot tub, the right is reserved to refund all monies and/or cancel a finance agreement without any form of compensation.
Upon day of installation, our trained & insured delivery team will assume full responsibility for the safe installation of your hot tub. You will not be requested to assist our installation team with the installation, and we ask that the area of installation is clear of any persons or pets. Any assistance that you or any person that is not a member of our trained installation department do provide will be at your own discretion and you accept that you do so at our own risk. The company will not be held liable for any injury suffered during any assistance that you do decide to provide.
The buyer will be deemed to have accepted the goods upon the completion of install. If upon inspection, you find that something is not of full satisfaction, American Hot Tubs shall at its option either repair or replace the defective part of as per the warranty details within a reasonable time and American Hot Tubs shall be liable for no other form of loss or compensation in that event including the loss of time or money in the event American Hot Tubs require access to the property at a later date.
6. Installation and Operating Requirements
The buyer should always observe the following installation and operating requirements and American Hot Tubs shall not be liable for any loss, whether direct, indirect or consequential, arising from any failure to do so.
Buyers are responsible for arranging, prior to delivery and installation the appropriate and required electricity supply. Buyers are advised to use a professional registered electrician and must ensure compliance with the manufacturer’s electrical instructions, requirements and electrical regulations relating to this type of installation.
Buyers must ensure in the event of the spa, or its supply line, going to earth this will only trip the supply to the spa compliance which store data or are affected by a disruption of supply. The correct size fuse, 30 milliamp ELCB/RCD, the correct size of cable to suit the spa and the length of cable run, must be fitted to any spa installation. If set up by American Hot Tubs is undertaken, this can only take place when the following requirements are in place. The correct electrical set up must be in place for American Hot Tubs upon install day and buyers should refer to the pre delivery guide on the website for a full detailed description of the electrical set up they require for the selected spa. There must be easy level access over hard (not soft) surfaces with adequate allowance for the spa on its transport trolley or mat, width and length, as well as difficult corners (Pictures sent to American Hot Tubs prior to delivery if unsure). American Hot Tubs may then place the goods in the position as instructed by the buyer. Indoor use is at the buyer’s risk and precautions must be made for leaks and access for the maintenance as well as taking appropriate actions to account for the build up of any additional heat of condensation in relation to the hot tub being placed indoors. Furthermore, spas should only be located on waterproof suitable flooring. A spa is a water filled vessel without an inbuilt drain. Spas can only be gravity drained slowly via a hose tail or pumped out with a submersible pump. Care should be taken to avoid drainage onto sensitive plants, ponds or running water containing fish or other life forms.
Any vessel of this type could leak and cause damage with volume of water involved. While indoor spa location is not recommended, if the spa is located indoors or on a surface where damage could occur, it is the responsibility of the buyer to make provision for dealing with a leak and limiting the risk of damage. Floor drainage should be considered on indoor locations where splash or leaks could cause problems, which any spa located over a basement or not on a ground floor should be fitted with a suitable bund tank with drain which should be able to handle the eventuality of any minor or major leak. Leaks can cause damage to both finish and structure of the surroundings if provision is not made to avoid such occurrence. Any damage by water or leaks within the hot tub are the sole responsibility of the buyer and American hot tubs will not be liable for any compensation in regards such. The buyer should note that all dimensions are approximate due to the variations in bespoke manufacture. Accordingly (although permanent fittings for spas are not recommended anyway) the buyer should not construct such fittings prior to delivery.
For any warranty work, buyers must ensure the hot tub is accessible from all sides and there is adequate working space
7. Removal and disposal of packaging
In order to keep the costs of our products down it remains the sole responsibility of the buyer to dispose of any packaging that may be left from the installation of the hot tub or any other service provided by American Hot Tubs. Should a buyer wish American Hot Tubs to remove and dispose of such material then a charge of £50 will be taken prior to American Hot Tubs doing so.
8. Representations and Referrals
Whilst American Hot Tubs will use every endeavour to give helpful advice and guidance to the buyer, to enable the buyer to make an informed choice, such advice will be limited to generalities and American Hot Tubs cannot be liable for specific circumstances relating to the buyer’s premises, intended use, or otherwise. Referrals, for example, the name of contractors who may be able to carry out certain work, such as Cranes, Hi-abs and electricians are given as a professional courtesy only, and American Hot Tubs cannot be responsible for any conduct or service provided by such contractors
If the manufacturer adopts any changes in construction or design of the goods to be supplied under the agreement, the buyer shall accept the goods so changed in performance of the contract provided that any such changes do not substancially alter the functions or characteristics of the goods.
10. Operation and Maintenance
Neither American Hot Tubs nor the manufacturer can be held responsible for any adverse consequences to the goods, property or person arising from the buyer’s failure to comply with the manufacturer’s operating and/or maintenance instructions. Changes or alterations to parts or components are also at the buyer’s risk. Any ongoing running costs, such as electricity or chemicals, outlined by American Hot Tubs are only given as an estimate and no compensation or refunds will be given by American Hot Tubs should any differences occur after the installation has been completed.
11. Warranty Claims
All claims under the manufacturer’s warranty should be directed to American Hot Tubs, quoting their surname, postcode, delivery date and model name as it appears on the order form. The warranty given on the tub will differ depending on the model purchased and this should be checked prior to any purchase and any claim. At no time will American Hot Tubs or any of its suppliers be responsible for any consequential losses incurred by customers using American Hot Tubs for commercial purposes. Any warranty supplied by American Hot Tubs will start from the day of install.
The Consumer Contracts Regulations 2013
The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations apply to sales of goods or services to consumers without face-to-face contact. This includes selling by mail order, online, using digital television or by telephone, fax or text message. The Regulations replaced the former Distance Selling Regulations.
Under the Regulations, you must:
give customers specified information before a sale is made;
confirm prior and certain other information in a durable form (eg in writing or email);
usually, give customers a right to cancel their order;
normally, fulfil your contractual obligations within 30 days unless otherwise agreed;
usually, give customers a full refund up to 14 days after receiving their goods, if they change their mind.
Before the sale is made
You must supply the following prior or pre-contract information:
your business name and, if you require payment in advance, your postal address;
a description of the goods or services and, if you are supplying them on a continuing basis, the minimum term;
the price (including taxes) and how long the price and any special offer will remain valid;
details of any delivery costs;
how payment can be made;
the arrangements for delivery (or performance of the service);
information about cancellation rights;
whether you will supply a substitute if the goods or services are not available (and, if so, confirmation that you will meet the cost of returning unwanted substitutes);
if the sale is of digital content, additional information about, for example, its functionality and compatibility.
You do not have to provide this information for sales of:
accommodation, transport, catering or leisure services to be provided on a specific date or within a specified period;
everyday food and drink delivered by a regular roundsperson (such as a milkman);
package travel or timeshare sales (covered by separate regulations);
premium rate telephone services (covered by separate regulations).
The following information also needs to be provided in writing ('durable' confirmation):
the prior information (see above);
how the customer can exercise their cancellation rights, including whether the contract requires them to return unwanted goods if they cancel, and who will pay the costs of returning those goods;
any guarantees or after-sales service you provide;
your geographical address for the customer to contact you with any complaints;
for contracts lasting more than one year (or indefinitely), under what conditions the contract can be cancelled.
The confirmation information must be provided in good time - at the latest, when the goods are delivered or the service performed. Information can be provided by letter, fax or email, or in the original mail order advertisement or catalogue.
Customers have the right to cancel a purchase within 14 calendar days of receiving goods or the durable confirmation (see above), whichever is later. This 'cooling off' period extends to a maximum of three months and seven working days after delivery if the customer is not given written ('durable') confirmation of the required information, and written confirmation of their right to cancel.
You must make a model cancellation form available for distance and door-step sales.
These cancellation rights do not apply to:
accommodation, transport, catering or leisure services to be provided on a specific date or within a specified period;
everyday food and drink delivered by a regular roundsperson (such as a milkman);
package travel or timeshare sales;
premium rate telephone services ;
goods made to a customer's specification (but not standard upgrades or variations);
goods that cannot be returned;
recordings and software that have been unsealed;
newspapers and magazines;
betting and similar services;
goods and services whose price depends on fluctuations in the financial markets;
digital downloads, once the download process has started - but this must be made clear to the consumer, and the consumer must explicitly agree to this.
Similar rules apply for services.
The Regulations do not require customers who cancel to return your goods, but they must take reasonable care of them and make them available for you to collect. You must refund the customer as soon as possible, but in any case within 14 calendar days of receipt of cancelled goods.
The exception is if your contract requires the customer to return your goods if they cancel. In that case, if they do not return them, they must pay your costs incurred in collecting them.
Exemptions to the Regulations
There are some exemptions. The Regulations do not apply to:
one-off distance sales made in response to a customer request (but not if you organise your business to regularly deal with such requests);
sales of financial services (these are covered by separate regulations, including the Financial Services Distance Marketing Regulations);
sales of land or buildings, including lease agreements for three years or more;
sales using vending machines or automated commercial premises, and public payphones;
sales at auction (including online auctions).
The E-Commerce Regulations 2002
The E-Commerce Regulations apply to any sales made electronically: for example, using email, through your website or via text. The regulations apply to sales to businesses as well as to consumers. (Distance sales to consumers using electronic means are covered by both the E-Commerce Regulations and the Consumer Contracts Regulations, above.)
Under the Regulations, when you advertise or sell, you must provide information including:
your business name, geographical address and contact details;
details of trade organisations or professional bodies you belong to;
information on any authorisation scheme (eg for financial services);
your VAT number;
prices, and whether they include taxes and delivery costs.
Any commercial communications (such as emails) must be clearly identifiable as a commercial communication from you, and clearly identify any promotional offers, competitions or games, and any conditions.
If you have automated systems allowing orders to be placed electronically (eg through your website), you must also provide additional information, including details of how contracts are made and how errors can be corrected. You must also provide prompt confirmation of the order.
The Consumer Rights Act 2015
The Consumer Rights Act covers goods and services ordered at home (for example through mail order catalogue, direct selling or online) and digital content. All goods must be as described, fit for purpose and of satisfactory quality. If goods are found to be faulty, you must give a full refund up 30 days after the item was purchased. If goods prove faulty up to six months after purchase and they can't be repaired or replaced, consumers are also now entitled to received a full refund in most cases.
Consumers are not entitled to demand a refund or replacement just because they change their mind.
If you sell digital content (eg music, games, ebooks or software), consumers can claim repair or replacement if the content they have downloaded is faulty. If the fault can't be fixed, or can't be fixed within a reasonable amount of time or without significant inconvenience to the consumer, they will be entitled to claim some or all of their money back.
Consumers also have a 14-day right to change their mind and claim a full refund for digital content they have purchased, unless they have already started to download it.

Spa Structure - 5 Years
American Hot Tubs warrants to the original retail purchaser the structural integrity of the spas against water loss from the spa due to defects in material or workmanship, in the spa structure for a period of five (5) years from the date of installation. (This includes the repair or replacement of the spa shell or any part of the structure)
Spa Shell Surface - 2 Years
American Hot Tubs warrants to the original retail purchaser that the acrylic finish will not blister, crack or delaminate for a period of two (2) years from the date of installation as a result of defects in material or workmanship. American Hot Tubs will either repair or replace the defective shell, including onsite labour to repair or replace the defective shell.
Spa Equipment - 2 Years (Please note for BeWell / Alps this is 3 Years)
American Hot Tubs warrants to the original retail purchaser the spa side equipment pack (pumps, heater, control system, keypad) should a component fail or malfunction due to defects in material or workmanship for a period of 2 years (2) years from the date of installation. American Hot Tubs will either repair or replace the defective component including replacement parts and onsite to labour install them.
Spa Plumbing - 2 Years
American Hot Tubs warrants to the original retail purchaser for a period two (2) years from the date of installation that the plumbing or spa will not leak due to defects in materials or workmanship. American Hot Tubs will provide replacement parts and onsite labour to repair or replace any defective components. Note that this does not include Jet inserts which as stated below in “Other Spa Components”, are warranted against malfunctions due to defects in materials and workmanship for a period of one (1) years from the date of installation.
American Hot Tubs warrants spa skirt and step to be free from defects in materials and workmanship at the time of delivery
Ozone – 1 Year
American Hot Tubs warrants to the original retail purchaser that the factory installed ozonators will not malfunction due to defects in the ozonator for a period of one (1) years from the date of installation. If the ozonators malfunction due to a defect in material or workmanship, Amercian Hot Tubs will either repair or replace the defective components including parts and onsite labour.
Audio Equipment - 1 Year
American Hot Tubs warrants to the original retail purchaser the stereo components against malfunctions due to defects in materials and workmanship for a period of one (1) year. This limited warranty on all audio systems covers onsite labour for a period of one (1) year from the original date of installation. After one year (1) the purchaser is solely responsible for any labour costs associated with the repair or replacement of a defective audio component. American Hot Tubs shall not be responsible for any damages or losses to any accessories , including but not limited to iPods or similar systems, caused by a defect or malfunction of any component. Note: Audio remote controls are not covered by the warranty. These are splash proof and not submersible in water. Radio reception is not covered by warranty because the reception depends on local conditions. The received signal may deteriorate if there are high voltage lined near the site
LED Light System - 1 Year
American Hot Tubs warrants to the original purchaser for a period of one (1) year form the date of installation that the factory installed LED light system will not malfunction due to defects in material or workmanship. If the LED system or any component there of malfunctions, American Hot Tubs will either repair or replace the defective components. This limited warranty on LED systems covers the onsite labour for a period of one (1) year from the date of installation. After one (1) year the purchaser is solely responsible for any labour costs associated with the repair or replacement of a defective component.
Cover and Headrests
American Hot Tubs warrants that the spa cover and headrest pillows to be free from defects in material or workmanship on delivery to the customer and are not covered under any additional warranty. Fading, discolouration, and scratches are all considered to be normal wear and tear or improper chemical balance. This also includes but is not limited to any chemical burns or discolouration of the cover as a result of being used on the spa. Zips and stitching are not covered under the terms of the warranty for the spa. Headrest pillows are to be removed from the spa when not in use.
Other Spa Components
American Hot Tubs warrant all other spa components, including but not limited to fuses, diverter caps, cover clips, and jet inserts against malfunction arising from defects in material and workmanship for a period of 1 years to the customer. Please note that for cover clips and jet inserts then this is a parts only warranty.
This limited warranty is enforceable only by the original retail purchaser. Spa covers and spa pillows are specifically excluded from this limited warranty. All warranties are void if the spa is placed in a commercial or rental property (as of 01/02/2019), (excluding our Holiday Let Spa). In the event it is necessary to remove the spa from the residential premises to repair or replace any warrantable item, any and all cost of spa removal and including but not limited to removal of the original spa and transportation of the replacement spa, damages to landscaping, decking, fencing or other structural alteration or any other cost related to obtaining access to the spa are the sole responsibility of the purchaser. This warranty does not cover damage caused by misuse, lack of maintenance, and act of god or lime scale deposits. American Hot Tubs is not responsible for any damage caused by alterations or modifications by the user.
All warranties here under are void if the spa has been subject to chemical misuse or chemical imbalances, alterations or modifications not authorised by American Hot Tubs, attempts to repair the spa not authorised by American Hot Tubs, incorrect use of the spa including but not limited to running the spa dry or filling the spa up incorrectly, electrical installation by a non-qualified electrician, ice in the spa, incorrect winter preparation, or commercial use. No part of the spa is warranted against chemical damage. This includes but is not limited to deposits of limescale on the spa shell or on spa components such as heater elements. Correct chemical use is the sole responsibility of the customer. The spa shell and components are not covered against any defects which may occur as a result of the customer not using the cover while the spa is not in use. This warranty does not cover damage arising from the use of unauthorised sanitisers such as tri-chlor, acids, calcium hypochlorite, sodium hypochlorite, peroxides, any sanitizing chemical that may remain undissolved on the spa surface.
Damage to headrest pillows reported beyond the day of delivery will not be covered under warranty.
Warranty Claim/Aftercare Procedure
All warranty claims must be registered by following the aftercare link on our website at . This will then ensure that your issue is passed over to the correct department. American Hot Tubs will then attempt to diagnose the fault over the phone and may suggest a number of solutions for the customer to attempt. Should this not resolve the issue American Hot Tubs aftercare team will then look to contact you within a reasonable time scale in order to book in an engineer visit. The aftercare department will be available Monday – Friday and excludes holiday periods which are at the discretion of American Hot Tubs. An Engineer upon attending the spa will attempt to diagnose and repair the issue. Should this not be possible on the day due to parts or any other reason then American Hot Tubs will look to book another visit in as soon as this is possible within a reasonable timescale. Upon attending a warranty visit, the customer must ensure there is full access to all sides of the spa in order for any diagnosis to take place from all sides and service points. Should this not be available on the day then American Hot Tubs reserve the right to charge a call out fee of £85 as well as the cost of the labour for that day and will have to return at another time.
If it is determined that the malfunction is not covered by the limited warranty, the cost of the service call is solely the responsibility of the purchaser. If it’s determined that the malfunction or defect is covered under the warranty, American Hot Tubs will repair or replace the covered item within a period of 21 days unless indicated that a part is not currently available.
Out with Warranty Period
When your warranty for certain aspects of your spa expires, then you of course do not need to use American Hot Tubs to diagnose or repair your spa. If however you choose to do so then you should do so by contacting us via the aftercare page at or calling the showroom. All call outs after a warranty period has expired will be charged at £85 which will be payable prior to an engineer attending your property. This will include 30 min of onsite labour. After this period, an hourly rate of £55 will be applied. Any parts or components required will be estimated and the owner given an estimated quote of any works required including the parts and estimated labour time for such work prior to work commencing. Should the engineer not have the required parts in the case that they need ordered then the work will be booked in by the relevant department and the engineer will return to do the job at a later date.

Warranty covering Parts and Labour
5 years warranty of the spa shell: the structural integrity of the spa against water loss from the spa due to defects in material or workmanship
2 years warranty on the main spa components: spa control, massage engines, pumps, heating components come with a 2 year warranty against defects in materials. (Please note for San Diego, Palma and San Fran Models this is limited to 1 year. Also note that for our Malibu hot tubs sold after 1/7/16 a 1 year warranty for main components is given on this product)
2 years warranty on the side panels of the spa. The factory installed side panel is warranted for 2 years from delivery date. Fading and weathering of the cabinet surface may occur naturally over time and shall not be considered a defect.
2 years warranty on spa plumbing. the plumbing or spa will not leak due to defects in materials or workmanship
1 years warranty on the ozone generator. The ozone generator is warranted against defects in materials for 2 years from delivery date
1 years warranty on the audio system components. The factory installed audio components (ie power supply, speakers, wires etc) are warranted against defects in materials for 1 year from delivery date. After one year the customer is solely responsible for any parts and labour costs associated with the repair or replacement of any parts of the audio system. Note: Audio remote controls are not covered by the warranty. These are splash proof and not submersible in water.
Cover and Headrests
American Hot Tubs warrants that the spa cover and headrest pillows to be free from defects in material or workmanship on delivery to the customer and are not covered under any additional warranty. Fading, discolouration, and scratches are all considered to be normal wear and tear. This also includes but is not limited to any chemical burns or discolouration of the cover as a result of being used on the spa. Zips and stitching are not covered under the terms of the warranty for the spa. Headrest pillows are to be removed from the spa when not in use.
1 years warranty on LED lights. The factory installed lights are warranted against defects in materials for 1 year from delivery date. After one year the customer is solely responsible for any parts and labour costs assosiated with the repair or replacement of any parts of the light system.
1 years warranty on the Jet ends and jet controls. The jets ends and plastic controls are covered against defects in materials for 1 year from the delivery date.
